Judge Lucy Koh has rejected Samsung’s application for Apple’s iPad and iPhone 5 3 to inspect. In the document of an 11-page she stated that although Samsung has the right to “parity”, requesting for Apple to hand over unreleased and belief enjoyed products was a bit overreaching.
While the decision for Apple sounds, the rejection of Samsung of movement is not permanent because the Court may have to wait until the iPhone 5 and iPad 3 be available for inspection before deciding whether or not “consumer confusion” will exist, as claimed by Apple. This also means that Apple is the preliminary draft warrant that would have excluded from Samsung from the sale of certain products in the United States can’t get.
Although Apple does not warrant the who wants to can get, it may make its legal battles against the Samsung unreleased focus and unnannounced products that an infringement threat. And the cycle continues.
